Terms & Conditions

By booking, participating in, or attending any Brew Bus Cape Town tour or event, guests agree to be bound by the following Terms and Conditions.

 

1. Definitions

 

“Brew Bus Cape Town”, “Brew Bus”, “we”, “our” and “us” refer to Brew Bus Cape Town and its owners, employees, agents, contractors, drivers and representatives.

 

“Guest”, “you” and “participant” refer to any person making a booking or participating in a Brew Bus experience.

 

2. Eligibility

 

2.1 All guests participating in brewery tours or consuming alcohol must be at least eighteen (18) years of age in accordance with South African law.

 

2.2 Brew Bus reserves the right to request valid photographic identification at any time.

 

2.3 Guests unable to provide proof of age may be refused participation without refund.

 

3. Bookings and Payments

 

3.1 Full payment is required to secure a booking unless otherwise agreed in writing.

 

3.2 A booking is confirmed only once payment has been received and confirmed by Brew Bus.

 

3.3 Prices are subject to change without prior notice.

 

4. Cancellation and Refund Policy

 

4.1 Cancellations made more than forty-eight (48) hours prior to departure qualify for a fifty percent (50%) refund.

 

4.2 No refunds will be issued for cancellations made within forty-eight (48) hours of the scheduled departure.

 

4.3 No refunds will be issued for no-shows, late arrivals, missed departures, voluntary withdrawal from the tour, intoxication-related removal, or early departure.

 

4.4 Brew Bus reserves the right to cancel or amend tours due to weather conditions, mechanical issues, insufficient passenger numbers, safety concerns, force majeure, or circumstances beyond our reasonable control.

 

5. Departure Times

 

5.1 Guests are required to arrive at least fifteen (15) minutes prior to departure.

 

5.2 The Brew Bus will depart at the advertised time and will not wait for late arrivals.

 

5.3 It is the guest’s sole responsibility to arrive at departure points on time.

 

6. Guest Conduct

 

6.1 Guests shall behave in a respectful and lawful manner at all times.

 

6.2 Aggressive, abusive, threatening, discriminatory, disorderly, dangerous or inappropriate behaviour will not be tolerated.

 

6.3 Brew Bus reserves the absolute right to refuse service, deny boarding or remove any guest whose conduct is deemed unsafe or disruptive.

 

6.4 Guests removed from a tour due to misconduct shall not be entitled to any refund or compensation.

 

7. Alcohol Consumption and Intoxication

 

7.1 Guests acknowledge that alcohol consumption forms part of the Brew Bus experience.

 

7.2 Guests participate voluntarily and assume all risks associated with alcohol consumption.

 

7.3 Brew Bus, its employees, agents, drivers and contractors reserve the right to refuse additional alcohol consumption, deny boarding, or terminate participation if a guest is considered excessively intoxicated.

 

7.4 Guests removed due to intoxication must arrange and pay for their own transportation and accommodation where necessary.

 

7.5 No refund or compensation shall be payable in such circumstances.

 

8. Safety

 

8.1 Guests must comply with all instructions provided by Brew Bus staff, drivers and brewery representatives.

 

8.2 Seat belts must be worn where fitted and available.

 

8.3 Guests participate entirely at their own risk.

 

8.4 Any guest failing to comply with safety instructions may be removed from the tour.

 

9. Assumption of Risk and Indemnity

 

9.1 Participation in Brew Bus experiences involves inherent risks, including but not limited to:

 

  • Transportation by road;

  • Alcohol consumption;

  • Slips, trips and falls;

  • Accidents;

  • Personal injury;

  • Illness;

  • Property damage;

  • Death.

 

9.2 Guests voluntarily participate and expressly assume all risks associated with participation.

 

9.3 To the fullest extent permitted by South African law, guests indemnify and hold harmless Brew Bus Cape Town, its owners, directors, employees, agents, contractors, drivers and affiliated breweries against any and all claims, liabilities, losses, damages, injuries, costs, expenses, legal fees, actions or proceedings arising directly or indirectly from:

 

  • Participation in a Brew Bus experience;

  • Consumption of alcohol;

  • Guest negligence or misconduct;

  • Acts or omissions of third parties;

  • Personal injury, illness or death.

 

9.4 Nothing in these Terms excludes liability where such exclusion is prohibited by law, including liability arising from gross negligence or wilful misconduct.

 

10. Medical Conditions

 

10.1 Guests are responsible for ensuring they are medically fit to participate.

 

10.2 Guests must disclose any medical conditions, allergies or disabilities that may affect participation.

 

10.3 Brew Bus accepts no responsibility for undisclosed medical conditions.

 

11. Personal Property

 

11.1 Guests are solely responsible for their personal belongings.

 

11.2 Brew Bus accepts no liability for lost, stolen or damaged personal property.

 

12. Damage to Property

 

12.1 Guests shall be responsible for any damage caused by them to vehicles, equipment, venues or property.

 

12.2 Brew Bus reserves the right to recover repair, cleaning, replacement and associated costs.

 

12.3 A cleaning fee may be charged where excessive cleaning is required, including but not limited to bodily fluids, vomiting, food or drink spillages.

 

13. Photography and Marketing

 

13.1 Brew Bus may take photographs or videos during tours for promotional purposes.

 

13.2 By participating, guests consent to the use of their image, likeness and voice for marketing and promotional purposes without compensation.

 

13.3 Guests wishing not to appear in marketing material must notify Brew Bus in writing prior to departure.

 

14. Force Majeure

 

Brew Bus shall not be liable for any failure or delay resulting from circumstances beyond its reasonable control, including but not limited to weather, natural disasters, strikes, road closures, accidents, pandemics, government restrictions or mechanical failures.

 

15. Privacy

 

Personal information shall be collected, processed and stored in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act, 2013 (“POPIA”).

 

16. Governing Law

 

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

 

17. Acceptance

 

By making a booking, payment, boarding a Brew Bus vehicle, or participating in any Brew Bus activity, guests acknowledge that they have read, understood and agree to these Terms and Conditions.
